Our Terms of Use

Ownership of Website Design

All original design, content, text, or images created or provided by GrowJitsu constitute the intellectual property of GrowJitsu. This encompasses templates, stock photos, and the abstract design and background of the website. Clients may utilize the website to promote their company or organization as long as they remain active subscribers of a GrowJitsu program inclusive of website design and hosting services. The right to resell the design or development to other companies is not granted. Cloning, copying, or exporting the design, content, text, or images provided by GrowJitsu is prohibited. Clients, however, retain the right to request direct editing of the site, make blog posts, or add pages. Sharing access to the website with a third party is permissible, but reusing components in a redesigned website giving another company design credit is not allowed. Upon discontinuation of services with GrowJitsu, all components of the website design remain the intellectual property of GrowJitsu.

Ownership of Website Domain Name

The client is 100% responsible for domain name purchase, renewal, and renewal fees. If the client opts for GrowJitsu to renew the domain name, an additional service fee applies. Clients are strongly advised to monitor the renewal date of their registered domain names, and GrowJitsu cannot be held responsible for expired domain names.

Ownership and Copyright

All text and photos used as content in a commissioned website must be provided by the client. Content provided by GrowJitsu for creating the website design remains the intellectual property of GrowJitsu. Clients must possess ownership or written permission to use all content they provide. It is the responsibility of each client to ensure that their design and/or content does not infringe on any trademark, service mark, or copyright. GrowJitsu is not liable for intellectual property infringements or submitted content.

Termination of Services

If the client decides not to proceed with GrowJitsu (changes their mind) during the initial web design or development phase, they are responsible for the work already completed. Depending on the work completed at the time of cancellation, additional fees may be owed.

Clients wishing to terminate any services must provide a written request for service termination 30 days in advance of the next billing cycle. There is no proration for partial billing cycles. Commencement of the final billing cycle results in discontinuation of all hosting and software services (including the GrowJitsu CRM) with GrowJitsu, potentially leading to website downtime if the client has not secured new hosting services and pointed their domain to new hosting and design services.

All subscription fees for the services rendered on our site are strictly non-refundable, and there will be no prorated refunds or credits for partially used subscriptions. While we retain the right to issue refunds or credits at our discretion, this will be done under specific circumstances. In instances where we significantly modify the Terms of Service or Privacy Policy during a billing period, and such modifications negatively impact you, we may refund a portion of your subscription fee equal to the remaining unused term (this would only apply to the current month’s billing cycle, not any past billing cycles). To request a refund, a written notice must be provided, identifying your account and requesting the cancellation of the specific Service. Refund requests will be evaluated and, if approved, effective upon our receipt of your notice and our determination that you are authorized to effect such cancellation.

GrowJitsu CRM Intellectual Property

Any original campaigns, content, text, or images created or provided by GrowJitsu remain the intellectual property of GrowJitsu. This includes templates, campaigns, workflows, funnels, and triggers in the GrowJitsu CRM. Clients retain all rights to their customized data and code for customizing the GrowJitsu CRM platform. Clients may use the GrowJitsu CRM to promote their company or organization as long as they remain actively subscribed clients of a GrowJitsu program that includes the GrowJitsu CRM platform and software. Reselling the GrowJitsu CRM or its development to other companies is not permitted. Clients do not have the right to clone, copy, or export the design, content, text, or images provided by GrowJitsu. However, clients have the right to grant access to staff to edit, customize, and manage the GrowJitsu CRM and to share access with a third-party marketing services provider.

Grounds for Termination

Clients acknowledge that GrowJitsu has the discretion to terminate or suspend access to all or part of the Site, with or without notice and for any reason, including breach of the Terms. Any suspected fraudulent, abusive, or illegal activity may lead to the barring of access and reporting to the proper authorities.

Loss of Rights to Service on Termination

Upon termination, regardless of the reason, the right to use the Services on the Site will cease immediately, and GrowJitsu shall not be liable for any claims for damages arising from such termination. The client’s liability for any unpaid fees survives termination.

Website Hosting

GrowJitsu utilizes a third-party hosting service to deploy websites and manage hosting and server uptime. Basic hosting fees and associated support costs are included at no extra charge. The client does not have the right to access GrowJitsu’s hosting account. GrowJitsu outsources website hosting services to WP Engine. The privacy policies and terms of use can be found here:

Acknowledging the likelihood of temporary interruptions on the Site, clients understand that GrowJitsu has no control over third-party networks or services used to provide Services. Clients agree that the Services available on the Site are provided “AS IS,” and GrowJitsu assumes no responsibility for the timeliness, deletion, missed delivery, interruption, or failure to store any user communications or personalization settings.

Governing Law

These Terms shall be governed by the laws of the Province of Alberta, Canada.
